General Terms and and Conditions of Delivery

Our deliveries are effected exclusively in accordance with the following terms and conditions of the German Civil Code (BGB) / German Commercial Code (HGB). All prices are without obligation; the prices valid on the day of delivery are charged. Errors excepted. All dealer prices are net prices for domestic deliveries to which the value-added tax is added at the applicable rate. Dealer prices according to our reselling price list are only granted against the presentation of a valid permit according to Sec. 7 (commercial) of the German Explosives Act. For deliveries to foreign countries, the bank charges accrued upon payment are invoiced separately.

These freight costs apply for deliveries within 7 to 10 working days. Direct deliveries and/or deliveries at scheduled dates by request (if necessary for a surcharge). For order values up to € 100, we charge you a lump sum of € 18 per shipment for administrative costs, packaging (packet if possible), shipment costs, etc. For small-quantity purchases (partial quantities), we charge a lump sum of € 15.

A cash discount of 2% is granted upon receipt of payment within 10 days after delivery and receipt of invoice. Otherwise, 30 days net cash. We grant a 3% cash discount for issuing a direct debit order. For new customers or customers in default, we reserve the right to make adjustments to the payment terms.

We reserve the right of ownership for all products that we delivered until the complete payment of all our claims arising out of the business relationship. If the payment date is exceeded, bank interest becomes payable to the usual amount. The place of performance for delivery and payment is the place of business of the company. The jurisdiction for both parties is Osnabrück.

If individual provisions are or become ineffective or unenforceable, the effectiveness of this contract is not otherwise affected thereby. An ineffective or unenforceable provision should be replaced by an effective and enforceable provision that comes as close as possible to the economic intent that the contractual parties pursued with the ineffective or unenforceable provision. The above provisions apply accordingly for the case that the contract should prove to be incomplete.
